Gov. Greg Abbott has declared that the federal government has failed Texas by breaking “the compact between the United States and the states” with its refusal to enforce the country’s immigration laws and protect Texas against the invasion of illegal immigrants it is currently experiencing.

In a statement, Abbott asserted that Texas has a constitutional right to defend itself from invasion if the federal government refuses to do its duty.

“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” said Abbott. “President [Joe] Biden has refused to enforce those laws and has even violated them. Abbott’s current feud with the federal government came after he challenged Biden’s policy of destroying the razor wire that the Texas National Guard placed along the Rio Grande to deter illegal immigrants from attempting border crossings. Abbott pointed out that Biden’s policy is more dangerous to illegals, as it incentivizes illegals to attempt the dangerous illegal crossings along the river where they are likely to drown rather than try to claim asylum at legal points of entry.

Biden brought this case to the Supreme Court, which voted in favor of the administration to allow federal Border Patrol agents to continue cutting the wire.

“By wasting taxpayer dollars to tear open Texas’ border security infrastructure, President Biden has enticed illegal immigrants away from the 28 legal entry points along this State’s southern border – bridged where nobody drowns – and into the dangerous waters of the Rio Grande,” said Abbott. “This illegal refusal to protect the States has inflicted unprecedented harm on the People all across the United States.”

Abbott also referenced how the framers of the U.S. Constitution, including Founding Fathers James Madison and Alexander Hamilton, “foresaw that States should not be left to the mercy of a lawless president who does nothing to stop external threats” such as Mexican cartels who smuggle illegal immigrants across the border.

The governor argues that this is why these Founding Fathers included a clause in the Constitution that mandates that the federal government “shall protect each [State] against invasion.”

Abbot further argues that the federal government’s failure to fulfill its constitutionally bound duty allows Texas to invoke its constitutional right to self-defense and its constitutional authority to protect its borders.

“That authority is the supreme law of the land and supersedes any federal statutes to the contrary,” said Abbott. “The Texas National Guard, the Texas Department of Public Safety and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border.”

 

Democrats calling on Biden to invade Texas and seize control of state’s National Guard

As Abbott continues to tout the state’s right to defend itself from the migrant invasion, Democratic lawmakers are calling on Biden to act decisively, not by enforcing the country’s migration laws but by taking control of the Texas National Guard.

Democratic lawmakers like Rep Greg Casar of Texas’ 35th congressional district have accused Abbott of orchestrating a “political stunt” and taking a play out of former President Donald Trump’s playbook.

“Greg Abbott has continued to use political stunts and inflammatory language to advance his own agenda, violating the Constitution and endangering both U.S. citizens and asylum seekers,” said Casar. “Abbott is following the Donald Trump playbook: Making immigration harder and more dangerous, so asylum seekers are pushed into the hands of cartels and the system remains broken.”

“I agree with [Rep. Joaquin Castro]: If Abbott is defying yesterday’s Supreme Court ruling, [the president]needs to establish sole federal control of the Texas National Guard,” continued Casar. “We can create an immigration system that is safe, orderly and humane. It’s Democrats’ job to push back on razor wire, inhumane cages and broken policies of the past.”

Failed Senate and gubernatorial candidate and former Rep. Beto O’Rourke also called out Abbott for using the Texas National Guard “to defy a Supreme Court ruling.”

“When Gov. Orval Eugene Faubus [of Arkansas]did this in 1957, [President Dwight] Eisenhower federalized the Arkansas Guard to ensure compliance with the law,” said O’Rourke. “Biden must follow this example of bold, decisive leadership to end this crisis before it gets worse.”
